The Dowry Jacob Paid For Rachel To Be His Wife

Genesis 29:13-30 reads,

29:13It happened, when Laban heard the news of Jacob, his sister’s son, that he ran to meet Jacob, and embraced him, and kissed him, and brought him to his house. Jacob told Laban all these things. 29:14Laban said to him, Surely you are my bone and my flesh. He lived with him for a month. 29:15Laban said to Jacob, "Because you are my brother, should you therefore serve me for nothing? Tell me, what will your wages be?"

29:16Laban had two daughters. The name of the elder was Leah, and the name of the younger was Rachel. 29:17Leah’s eyes were weak, but Rachel was beautiful and well favored. 29:18Jacob loved Rachel. He said, "I will serve you seven years for Rachel, your younger daughter."

29:19Laban said, "It is better that I give her to you, than that I should give her to another man. Stay with me."

29:20Jacob served seven years for Rachel. They seemed to him but a few days, for the love he had for her.

Rachel Became Jacob's Wife After He Had Paid Her Dowry But Prior To Their Sexual Union

29:21Jacob said to Laban, "Give me my wife, for my days are fulfilled, that I may go in to her."

Jacob Unwittingly Married Leah Before Wittingly Marrying Rachel

29:22Laban gathered together all the men of the place, and made a feast. 29:23It happened in the evening, that he took Leah his daughter, and brought her to him. He went in to her. 29:24Laban gave Zilpah his handmaid to his daughter Leah for a handmaid. 29:25It happened in the morning that, behold, it was Leah. He said to Laban, "What is this you have done to me? Didn’t I serve with you for Rachel? Why then have you deceived me?"

29:26Laban said, "It is not done so in our place, to give the younger before the first born. 29:27Fulfill the week of this one, and we will give you the other also for the service which you will serve with me yet seven other years."

29:28Jacob did so, and fulfilled her week. He gave him Rachel his daughter as wife. 29:29Laban gave to Rachel his daughter Bilhah, his handmaid, to be her handmaid. 29:30He went in also to Rachel, and he loved also Rachel more than Leah, and served with him yet seven other years.

A Woman's Father Has Capacity To Give Her As Wife

It should be noted that a woman's father indeed has capacity to give her to a man as his wife, for Laban had capacity to give his daughters as wife to whomever he chose.

A Woman Becomes A Man's Wife At Betrothal

It should be noted from 29:21 that Jacob considered Rachel his wife after he had served the agreed seven years for her. In other words, his agreement with her father was that she would become his wife after he had served her father seven years. Once he had fulfilled his service Rachel became his wife. All that remained was for he and his wife to become one sexually.

A Man Can Unwittingly Take A Wife

At the time appointed for Jacob to sexually lie with Rachel her father did not release her for this purpose, but instead released her less attractive sister Leah, unbeknown to Jacob. Jacob therefore sexually lay with Leah, thinking all along that he had sexually lain with Rachel. He therefore found himself to have unwittingly married Leah, who had been duly given as his wife by her father, and had apparently acquiesced in the matter.

It should be noted that a woman can become a man's wife even when the man has been deceived as to her identity. For Leah became Jacob's wife after she sexually lay with Jacob yet Jacob had not at that point in time been aware that she was the one he lay with.

It should therefore be noted that just as a man can sin against Yahweh by unwittingly taking as his wife a woman who is already another man's wife, so can a man unwittingly take as his wife a woman he thought was another woman. For provided the woman he unwittingly takes as his wife has been given to him as his wife by those with capacity to do so, and he sexually lies with her, she indeed becomes his wife!

Postponement Of A Betrothed Wife's Marriage Does Not Terminate Her Betrothal

It should be noted that even though Jacob did not sexually lie with Rachel at the originally appointed time, her betrothal to him continued to exist. She was therefore still his betrothed wife, even though he had yet to sexually lie with her, and waited another seven years before so doing.

It therefore appears that the postponement of the time a husband and wife ought to sexually lie together does not in any way sever the betrothal, even a postponement lasting seven years, as in the case of Jacob and Rachel.

Rachel Gave Her Maid As Wife To Her Husband

Genesis 30:1-4 reads,

30:1When Rachel saw that she bore Jacob no children, Rachel envied her sister. She said to Jacob, "Give me children, or else I will die."

30:2Jacob’s anger was kindled against Rachel, and he said, "Am I in God’s place, who has withheld from you the fruit of the womb?"

30:3She said, "Behold, my maid Bilhah. Go in to her, that she may bear on my knees, and I also may obtain children by her." 30:4She gave him Bilhah her handmaid as wife, and Jacob went in to her.

It should be noted that a woman can be given as wife to a man by one with capacity to give her away as wife. Those with such capacity include Yahweh, a woman's father or a woman's master or mistress if she is a slave woman or maid. In Bilhah's case, being a maid, her mistress Rachel had capacity to give her as wife to a man.

Why Did The Women In Abraham's Household Give Their Maids To Their Husbands As Wives?

It should be noted that in the case of Sarah with her maid Hagar, and that of Rachel with her maid Bilhah, the mistresses gave their maids as wives to their husbands. The mistresses did not give their maids to another man. Why was this?

Children Borne By A Maid Legally Belong To Her Master Or Mistress

In both cases what motivated them to give their maids to their husbands as wives was for their husbands to sire children who would be credited to them. In other words, by the maids being given as wives to their husbands the maids would not cease to be maids to them, but would continue to be of service to them. The children borne by the maids would be considered the children of their households and not those of separate households pertaining to the maids.

What Happens When A Mistress Gives Her Maid As Wife To A Man Outside Her Husband's Household?

Is it the case that if a mistress gives her maid as wife to a man not her husband that she effectively releases her maid from service to her? For by being wife to a man not her husband she comes under the authority of that man and outside her authority? But if she is to retain authority over the maid, thereby not releasing her from her service, is she restricted to giving her as wife only to her husband, thereby ensuring that no conflict of authority takes place? With respect to their relationship to her husband the mistress has superior status, seeing that the maid is still under her mistress's authority.

Leah Gave Her Maid As Wife To Her Husband

Genesis 30:9 reads,

30:9When Leah saw that she had finished bearing, she took Zilpah, her handmaid, and gave her to Jacob as a wife.

Leah also did as her sister Rachel had done, having capacity to give her handmaid to her husband as a wife. It should therefore be very clear that mistress can indeed give as wife any maid under her authority.

Dinah Did Not Become Shechem's Wife Despite Having Been Raped By Him

Genesis 34 reads,

34:1Dinah, the daughter of Leah, whom she bore to Jacob, went out to see the daughters of the land. 34:2Shechem the son of Hamor the Hivite, the prince of the land, saw her. He took her, lay with her, and humbled her. 34:3His soul joined to Dinah, the daughter of Jacob, and he loved the young lady, and spoke kindly to the young lady. 34:4Shechem spoke to his father, Hamor, saying, "Get me this young lady as a wife."

Shechem's Father Spoke With Dinah's Father To Persuade The Latter To Give Her As Wife To The Former's Son

34:5Now Jacob heard that he had defiled Dinah, his daughter; and his sons were with his cattle in the field. Jacob held his peace until they came. 34:6Hamor the father of Shechem went out to Jacob to talk with him. 34:7The sons of Jacob came in from the field when they heard it. The men were grieved, and they were very angry, because he had done folly in Israel in lying with Jacob’s daughter; which thing ought not to be done. 34:8Hamor talked with them, saying, "The soul of my son, Shechem, longs for your daughter. Please give her to him as a wife. 34:9Make marriages with us. Give your daughters to us, and take our daughters for yourselves. 34:10You shall dwell with us: and the land will be before you. Live and trade in it, and get possessions in it."

Shechem Was Willing To Pay Whatever Dowry Jacob's Household Stipulated

34:11Shechem said to her father and to her brothers, "Let me find favor in your eyes, and whatever you will tell me I will give. 34:12Ask me a great amount for a dowry, and I will give whatever you ask of me, but give me the young lady as a wife."

The Dowry Jacob's Household Demanded Of Shechem

34:13The sons of Jacob answered Shechem and Hamor his father with deceit, and spoke, because he had defiled Dinah their sister, 34:14and said to them, "We can’t do this thing, to give our sister to one who is uncircumcised; for that is a reproach to us. 34:15Only on this condition will we consent to you. If you will be as we are, that every male of you be circumcised; 34:16then will we give our daughters to you, and we will take your daughters to us, and we will dwell with you, and we will become one people. 34:17But if you will not listen to us, to be circumcised, then we will take our sister, and we will be gone.

34:18Their words pleased Hamor, and Shechem, Hamor’s son. 34:19The young man didn’t wait to do this thing, because he had delight in Jacob’s daughter, and he was honored above all the house of his father. 34:20Hamor and Shechem, his son, came to the gate of their city, and talked with the men of their city, saying, 34:21"These men are peaceful with us. Therefore let them live in the land and trade in it. For, behold, the land is large enough for them. Let us take their daughters to us for wives, and let us give them our daughters. 34:22Only on this condition will the men consent to us to dwell with us, to become one people, if every male among us be circumcised, as they are circumcised. 34:23Won’t their cattle and their substance and all their animals be ours? Only let us give our consent to them, and they will dwell with us."

34:24All who went out of the gate of his city listened to Hamor, and to Shechem his son; and every male was circumcised, all who went out of the gate of his city. 34:25It happened on the third day, when they were sore, that two of Jacob’s sons, Simeon and Levi, Dinah’s brothers, each took his sword, came upon the unsuspecting city, and killed all the males. 34:26They killed Hamor and Shechem, his son, with the edge of the sword, and took Dinah out of Shechem’s house, and went away. 34:27Jacob’s sons came on the dead, and plundered the city, because they had defiled their sister. 34:28They took their flocks, their herds, their donkeys, that which was in the city, that which was in the field; 34:29and all their wealth. They took captive all their little ones and their wives, and took as plunder everything that was in the house. 34:30Jacob said to Simeon and Levi, "You have troubled me, to make me odious to the inhabitants of the land, among the Canaanites and the Perizzites. I am few in number. They will gather themselves together against me and strike me, and I will be destroyed, I and my house."

34:31They said, "Should he deal with our sister as with a prostitute?"

Sex Between A Man And An Unbetrothed Woman Does Not Make Them Husband And Wife

It is evident from 34:2-4 that even though Shechem had sexually lain with Dinah she was still not his wife. It is therefore the case that a woman who is not wife to a man who sexually lies with a man does not automatically become that man's wife by that sexual action. Therefore sex on its own, without other relevant factors, does not make a man and woman husband and wife, even a woman who is not wife to another man.

The Relevant Factors That Make A Man And A Woman Husband And Wife

What are the relevant factors that make a man and woman husband and wife?

Earlier on it was seen that the woman must be given as the man's wife by one with capacity to so give her away as wife. Her consent is also required. The man's consent, either by word or sexual intercourse, is also required. Once these relevant consents exist the man and woman become husband and wife.

In Shechem and Dinah's case the only consent clearly evident is that of Shechem. Her father had not consented to her being Shechem's wife, nor had Dinah consented to being Shechem's wife. It should therefore be clear why both Shechem and his father Hamor understood that Dinah was not Shechem's wife, despite Shechem having sexually lain with her.

It Is Appropriate For A Father To Procure A Wife For His Son

It should be noted that the Hivites also understood that is indeed appropriate for a father to procure a wife for his son, even as Abraham procured Rebekah for his son Isaac.

A Man Should Not Sexually Lie With A Woman Not His Wife

34:7 shows that Jacob's sons understood that a man should not sexually lie with a woman who is not his wife, especially when he forces himself upon her.

Even The Hivites Understood That Dinah Was Not Shechem's Wife

34:8 reiterates Hamor's understanding that Dinah was not Shechem's wife, despite Shechem having sexually lain with her. On the strength of this understanding he sought to persuade Jacob's household to give Dinah to Shechem as a wife. It should therefore be clear that a woman who sexually lies with a man does not become wife to that man simply on account of that sex between them. The critical factors facilitating her being his wife must indeed be fulfilled before she becomes his wife, notwithstanding that she has sexually lain with a man.

The Amount Of Dowry Paid Is Not A Critical Factor In Ratifying A Husband And Wife Relationship

It should be noted from 34:12 and from the earlier cases of Abraham's household and Bethuel's household, and Jacob and Laban, that the amount of dowry paid by the man's household to the woman's household is not a critical factor in ratifying a husband and wife relationship. For in Abraham's case no formal dowry is noted as paid, only presents given to the woman, her mother and her brother. In Jacob's case he served the women's father seven years for each of his two wives. In Shechem's case he expressed his willingness to pay whatever dowry that Jacob's household named. The amount of dowry therefore does not appear to be critical in ratifying a husband and wife relationship.

Dowry Is Necessary To Secure The Consent Of A Woman's Family To Give Her As Wife To A Man

In Jacob and Laban's case and in the Jacob and Hamor's households' case, it appears that the amount of dowry is significant for purposes of persuading the woman's family to give her as a wife to the man. But if the woman's family is not insistent on dowry then no dowry really needs to be paid except for a token amount. For the important matter is the consent of the woman's family, including that of her father and her own, together with the consent of the man. Once these are present then the woman indeed becomes wife to the man.

Jacob's Sons Clearly Understood That Dinah Was Not Shechem's Wife At The Time Of Dowry Negotiations

34:17 again reiterates that Dinah was not Shechem's wife, even after having sexually lain with him. For had she been his wife her brothers would have had no authority to take her away from Shechem. But that her brothers clearly understood that they could clearly shows that she was not yet Shechem's wife, despite having sexually lain with Shechem.

It Is Prostitution For A Man To Lie With A Woman Not His Wife

34:31 clearly shows that it is indeed prostitution for a woman to willingly sexually lie with a man while she is not wife to that man. And a man who sexually lies with a woman not his wife is indeed partaking of prostitution, dealing with that woman as with a prostitute.

There Are Various Ways A Man Can Take A Woman As His Wife

Genesis 38 reads,

38:1It happened at that time, that Judah went down from his brothers, and turned in to a certain Adullamite, whose name was Hirah. 38:2Judah saw there a daughter of a certain Canaanite whose name was Shua. He took her, and went in to her. 38:3She conceived, and bore a son; and he named him Er. 38:4She conceived again, and bore a son; and she named him Onan. 38:5She yet again bore a son, and named him Shelah: and he was at Chezib, when she bore him. 38:6Judah took a wife for Er, his firstborn, and her name was Tamar. 38:7Er, Judah’s firstborn, was wicked in the sight of Yahweh. Yahweh killed him. 38:8Judah said to Onan, "Go in to your brother’s wife, and perform the duty of a husband’s brother to her, and raise up seed to your brother." 38:9Onan knew that the seed wouldn’t be his; and it happened, when he went in to his brother’s wife, that he spilled it on the ground, lest he should give seed to his brother. 38:10The thing which he did was evil in the sight of Yahweh, and he killed him also. 38:11Then Judah said to Tamar, his daughter-in-law, "Remain a widow in your father’s house, until Shelah, my son, is grown up;" for he said, "Lest he also die, like his brothers." Tamar went and lived in her father’s house.

Tamar Prostituted Herself When Judah Did Not Give Her In Marriage To His Son, Her Betrothed Husband

38:12After many days, Shua’s daughter, the wife of Judah, died. Judah was comforted, and went up to his sheep-shearers to Timnah, he and his friend Hirah, the Adullamite. 38:13It was told Tamar, saying, "Behold, your father-in-law is going up to Timnah to shear his sheep." 38:14She took off of her the garments of her widowhood, and covered herself with her veil, and wrapped herself, and sat in the gate of Enaim, which is by the way to Timnah; for she saw that Shelah was grown up, and she wasn’t given to him as a wife. 38:15When Judah saw her, he thought that she was a prostitute, for she had covered her face. 38:16He turned to her by the way, and said, "Please come, let me come in to you:" for he didn’t know that she was his daughter-in-law.

She said, "What will you give me, that you may come in to me?"

38:17He said, "I will send you a kid of the goats from the flock."

She said, "Will you give me a pledge, until you send it?"

38:18He said, "What pledge will I give you?"

She said, "Your signet and your cord, and your staff that is in your hand."

He gave them to her, and came in to her, and she conceived by him. 38:19She arose, and went away, and put off her veil from her, and put on the garments of her widowhood. 38:20Judah sent the kid of the goats by the hand of his friend, the Adullamite, to receive the pledge from the woman’s hand, but he didn’t find her. 38:21Then he asked the men of her place, saying, "Where is the prostitute, that was at Enaim by the road?"

They said, "There has been no prostitute here."

38:22He returned to Judah, and said, "I haven’t found her; and also the men of the place said, ‘There has been no prostitute here.’" 38:23Judah said, "Let her keep it, lest we be put to shame. Behold, I sent this kid, and you haven’t found her."

38:24It happened about three months later, that it was told Judah, saying, "Tamar, your daughter-in-law, has played the prostitute; and moreover, behold, she is with child by prostitution."

Judah said, "Bring her forth, and let her be burnt." 38:25When she was brought forth, she sent to her father-in-law, saying, "By the man, whose these are, I am with child." She also said, "Please discern whose are these - the signet, and the cords, and the staff."

Judah's Failure To Honour Tamar's Betrothal Was More Sinful That Tamar's Subsequent Prostitution

38:26Judah acknowledged them, and said, "She is more righteous than I, because I didn’t give her to Shelah, my son."

He knew her again no more. 38:27It happened in the time of her travail, that behold, twins were in her womb. 38:28It happened, when she travailed, that one put out a hand: and the midwife took and tied a scarlet thread on his hand, saying, "This came out first." 38:29It happened, as he drew back his hand, that behold, his brother came out, and she said, "Why have you made a breach for yourself?" Therefore his name was called Perez. 38:30Afterward his brother came out, that had the scarlet thread on his hand, and his name was called Zerah.

A Man Has Capacity For Both Taking A Wife For Himself And Also For His Son

It should be noted from Judah's life that a man has capacity to take a wife for himself. He also has capacity to take a wife for his son. A son should therefore be willing to participate in his father procuring a wife for him.

A Widow Of A Man Without Descendants Is Automatically Betrothed As Wife To One Of His Surviving Brothers

It should also be noted that if a man dies leaving behind a widow, and does not yet have descendants, his widow is automatically betrothed as wife to one of his surviving brothers. She is to be married by one of his brothers and not by a man not closely related to his brother. The purpose of this law is to raise seed for the dead brother, seed that will inherit property that was due to pass onto the dead brother.

Tamar Was Shelah's Wife Even Though They Hadn't Come Together Sexually

It should be noted that there wasn't a doubt that Tamar had played the prostitute, for she had willingly sexually lain with a man not her husband, yet she was indeed the wife of Shelah. Nevertheless, Shelah had not yet sexually lain with her as his father had yet to authorise their sexual union.

It should be noted that 38:11 refers to Tamar as Judah's "daughter-in-law", and 38:25 refers to Judah as Tamar's "father-in-law". Yet at the times they are so referred Shelah had not sexually lain with Tamar, Tamar only being betrothed as Shelah's wife. It should therefore be clear that once a woman has been betrothed to a man she is indeed that man's wife. The time she sexually lies with that man could be several years after her betrothal to him. Nevertheless, delay in her sexually lying with her husband does not negate her being her husband's wife!

Why Tamar Played The Prostitute

Why did Tamar play the prostitute?

Because Judah had been unfaithful to her, in that he did not honour to her his word to her. For he had assured her that she would be given in sexual union to Shelah once Shelah was grown up. Nevertheless, once Shelah was grown up, Judah did not honour his word to her. Judah's failure to keep his word to Shelah is what contributed to Tamar's prostitution. For had Judah kept his word Tamar would have had no cause to play the prostitute.

The Penalty For Playing The Prostitute Is Death

It should be noted that the penalty for playing the prostitute is death!

The Penalty For Violating A Betrothal Is Death

It should also be noted from 38:26 that between Judah and Tamar the one with the greater sin was Judah! For it was Judah's unfaithfulness to Tamar, by failing to keep his word to her to give her in sexual union to Shelah once Shelah was grown up that contributed to Tamar playing the prostitute. Judah's unfaithfulness to Tamar therefore caused Tamar to play the prostitute, and for so being unfaithful he bore responsibility for Tamar's sin!

This did not excuse Tamar of all responsibility for her sin. For she willingly played the prostitute and was not raped. Nevertheless, had Judah been faithful she would have had no cause to play the prostitute. She therefore had lesser responsibility in the matter of her prostitution.

Seeing that the penalty for prostitution is death, and that Judah's sin was worse than Tamar's sin, it is indeed the case that Judah deserved to die for his sin of violating Tamar's betrothal. In other words, the penalty for violating a betrothal is death!

A Betrothed Woman's Husband Does Not Change When Her Betrothal Is Violated

38:26 notes that Judah did not sexually lie with Tamar again. The reason is that Tamar was his daughter-in-law, and not his wife, despite his having sexually lain with her without knowing that she was his daughter-in-law! For 38:16 shows that the reason Judah sexually lay with Tamar was that he did not know that she was his daughter-in-law, implying that had he known he would not have sexually lain with her. It should therefore be clear that just because Judah unwittingly sexually lay with Tamar did not make Tamar his wife. Tamar was already his daughter-in-law, being the betrothed wife of Shelah. A woman betrothed to one man does not become wife to another man when the other man sexually lies with her prior to her husband sexually lying with her. She remains the wife of the man she is betrothed to, despite having sexually lain with another man!

It should also be remembered from the case of Judah's sister, Dinah, that just because a woman sexually lies with a man does not make her that man's wife, even if she is not betrothed at the time the man sexually lies with her. For her to be wife to that man critical consents must first be obtained, after which she becomes his wife. And seeing that a betrothed woman is already wife to a man, any other man who sexually lies with her sins against Yahweh, thereby bringing upon his household guilt, until such time as Yahweh forgives him his sin.

The Appointed Time For Marriage Of A Betrothed Woman Should Not Be Unduly Delayed

Learning from Judah and Tamar's case, it should be appreciated that once the appointed time for a woman betrothed to a man to sexually lie with him has come, she should indeed sexually lie with him. She should not be unduly prevented from so sexually lying with him. So preventing her may lead her to seek sexual gratification with another man, thereby playing the prostitute, and the man with whom she plays the prostitute unwittingly bringing guilt upon his household by his sin! In Jacob and Rachel's case it was indeed by Yahweh's grace that Rachel did not sexually lie with another man over the seven years after the time originally appointed for her to sexually lie with her husband Jacob. But if Yahweh does not intervene to prevent a betrothed woman sexually lying with another man, a man not her husband, it is indeed likely that she will do so, if the time appointed for her to be sexually united with her husband is unduly delayed.

How To Avoid Coveting Another Man's Wife

Exodus 20:17 reads,

20:17"You shall not covet your neighbor’s house. You shall not covet your neighbor’s wife, nor his man-servant, nor his maid-servant, nor his ox, nor his donkey, nor anything that is your neighbor’s."

As seen in the cases of Pharaoh and Abraham's wife, Abimelech and Abraham's wife and Judah and Shelah's wife, a man can unwittingly covet his neighbour's wife! To avoid unwitting sin, especially that of coveting a neighbour's wife, a man should pray to Yahweh to lead and guide him to the woman or women he has appointed as wife or wives to him. These are the ones the man should take as wife. And by following this procedure the man will not unwittingly sin against Yahweh in taking as wife a woman already wife to another, whether already married to another or betrothed to another.

A Slave Woman Given As Wife By Her Master Is Not Released From Her Slavery By This Action

Exodus 21:2-5 reads,

21:2If you buy a Hebrew servant, he shall serve six years and in the seventh he shall go out free without paying anything. 21:3If he comes in by himself, he shall go out by himself. If he is married, then his wife shall go out with him. 21:4If his master gives him a wife and she bears him sons or daughters, the wife and her children shall be her master’s, and he shall go out by himself. 21:5But if the servant shall plainly say, ‘I love my master, my wife, and my children. I will not go out free;’ 21:6then his master shall bring him to God, and shall bring him to the door or to the door-post, and his master shall bore his ear through with an awl, and he shall serve him for ever.

It should be noted that when a master or mistress gives his or her maid as wife to a man in his household that maid is not released from her slavery or service. She continues to be under the authority of her master or mistress. Her children also, whom she bears, belong to her master or mistress, even as she belongs to her master or mistress.

Hagar Was Not Released From Being Slave To Sarai When She Became Abram's Wife

It is in this context that Sarah gave her slave Hagar as wife to her husband. Hagar was not released from slavery by her being wife to Abraham, even as Abraham noted in his comments to Sarah in Genesis 16:6,

16:6But Abram said to Sarai, "Behold, your maid is in your hand. Do to her whatever is good in your eyes." Sarai dealt harshly with her, and she fled from her face.

Hagar's son Ishmael therefore legally belonged to Sarah.

Also, by the same token, the children born to Leah and Rachel's maids respectively belonged to Leah and Rachel, as Zilpah and Bilhah were their maids and therefore had no legal right to their own biological children.

To Avoid Conflict Of Authority A Slave Woman Should Be Given As Wife To A Man In One's Household

Seeing that a slave woman is not released from her slavery when given as wife to a man, it appears prudent that her master or mistress should give her as wife only to a man in his or her household, in order to avoid conflict of authority. Her master should give her to either a son or a male slave in his household. Her mistress should give her to her husband or to her son or to a male slave in her household, that is her husband's household.

Distinction In Legal Right Between A Slave Woman And A Free Woman

It seems that the distinction between a wife who is a free woman and one who is a slave woman concerns their respective legal rights. The children of a slave woman do not legally belong to her, these belonging to either her master or mistress. Therefore even if she is married to a man outside her master or mistress's household the children she bears through this man's seed do not legally belong to this man but legally belong to her master or mistress.

It Is Prudent Not To Marry Another Person's Slave Woman

A man who desires to have legal ownership of his biological children should not take as wife a woman who is another's slave. He should seek either a free woman or a woman who is his own slave, thereby ensuring that his biological children legally belong to him.

A Virgin Not Pledged To Be Married Does Not Become A Man's Wife By Their Sexual Union

Exodus 22:16-17 reads,

22:16"If a man entices a virgin who isn’t pledged to be married, and lies with her, he shall surely pay a dowry for her to be his wife. 22:17If her father utterly refuses to give her to him, he shall pay money according to the dowry of virgins.

It should be noted that a virgin who isn't pledged to be married does not become wife to any man until such time as her father consents to give her as wife to a man. It is irrelevant that a man has enticed her and sexually lain with her, showing that both the consent of the man and the woman exist. For if the other critical consent, that of the father, does not exist then she does not become wife to the man.

Yahweh's law here is seen to be in harmony with the understanding of the Hamor and Shechem the Hivites, and that of Jacob's household, when Shechem had sexually forced himself upon Dinah. In other words, a virgin who isn't pledged to be married does not become wife to the first man she gives herself to sexually. Such conduct is prostitution, as Jacob's children clearly understood. She becomes the man's wife only after her father has given her as wife to that man!

There Are Different Categories Of Dowry

22:17 specifies dowry of a particular category - that of virgins. It appears that there are different valuations of dowry depending on circumstances.

A man who takes away a woman's virginity must pay dowry to her father according to the valuation of dowry for virgins. If the woman is not a virgin it appears that the valuation is less.

A Dowry Ought To Be Paid When A Man Takes A Woman As Wife

That Yahweh has specified that a dowry must be paid shows that it is indeed necessary for one to pay dowry when taking a woman as one's wife. But the valuation of dowry varies with the categorisation of woman one is taking as wife, depending on her circumstances.
